Terms of Use
Last updated: October 2026
Welcome to aushco.com (the “Site”), operated by Aushco Commercial Real Estate (“Aushco,” “we,” “us,” or “our”). These Terms of Use (the “Terms”) govern your access to and use of the Site, including our property listings, forms, and content. Please read them carefully.
1. Acceptance of These Terms
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
2. Information Only; No Client Relationship
The Site provides general information about our brokerage, property management, maintenance, and medical and healthcare real estate services. It is not legal, tax, financial, investment, or other professional advice. Visiting the Site, sending us a message, or submitting a form does not create a broker-client, property management, or other business relationship with Aushco. Any engagement begins only when you and Aushco sign a written agreement. Our services are offered only where we are permitted to provide them.
3. Property Listings and Market Information
Listings on the Properties page are provided through a third-party platform, Buildout, and may include information supplied by property owners and other sources. While we aim to keep listings current, we do not guarantee that any listing, price, rate, square footage, availability, or other detail is accurate, complete, or up to date. Listings are subject to errors, omissions, change, prior sale or lease, and withdrawal without notice. Nothing on the Site is an offer to sell or lease, or a commitment to do so. Please verify all information independently and contact us for the latest details before you rely on it.
4. Maintenance and Service Requests
Submitting a service request through the Site lets us know about a need, but it does not guarantee a response time, availability of service, or that we will perform the work. Our maintenance and property management services are provided under separate agreements with property owners. The Site is not monitored around the clock and must not be used to report emergencies. If anyone is in danger, call 911. For urgent building issues, such as a fire, flooding, or loss of utilities, call our office at 240-578-4220 or use the emergency contact provided for your property.
5. Using the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- Break any law or regulation, or infringe the rights of others.
- Submit information that is false, misleading, or about someone else without their permission.
- Attempt to gain unauthorized access to the Site, our systems, or other users’ information.
- Interfere with or disrupt the Site, including by introducing viruses or other harmful code.
- Use bots, scrapers, or other automated means to collect content or listing data from the Site without our written permission.
- Use the Site or its content to send unsolicited advertising or to compete with us.
6. Information You Submit
When you submit a form or message, you agree to provide accurate information. You give Aushco permission to use what you submit to respond to you, provide our services, and communicate with you, as described in our Privacy Policy. Please do not include sensitive information such as Social Security numbers or financial account numbers.
7. Intellectual Property
The Site and its content, including text, photographs, graphics, logos, the Aushco name, and design, are owned by Aushco or its licensors and are protected by copyright, trademark, and other laws. You may view and print pages of the Site for your own personal or internal business use. You may not copy, reproduce, modify, distribute, or create derivative works from the Site or its content without our prior written permission.
8. Third-Party Content and Links
The Site includes content and tools from third parties, such as Buildout listings, Google Maps, and links to our social media pages. We do not control these third parties and are not responsible for their content, accuracy, availability, or practices. Your use of third-party services is subject to their own terms and policies.
9. Disclaimer of Warranties
The Site and its content are provided “as is” and “as available.” To the fullest extent permitted by law, Aushco disclaims all warranties, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or free of errors or harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, Aushco and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or related to your use of, or inability to use, the Site or reliance on its content. Where liability cannot be excluded, it is limited to the extent the law allows. Nothing in these Terms limits liability that cannot be limited by law.
11. Indemnification
You agree to defend, indemnify, and hold harmless Aushco and its owners, employees, and agents from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or your misuse of the Site.
12. Governing Law and Venue
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in or serving Frederick County, Maryland, and you consent to their jurisdiction.
13. Changes to the Site and These Terms
We may change, suspend, or discontinue any part of the Site at any time. We may also update these Terms from time to time. We will post the updated Terms on this page and change the “Last updated” date above. Your continued use of the Site after a change means you accept the updated Terms. If any part of these Terms is found unenforceable, the rest will remain in effect.
